These Terms & Conditions (“Terms”) govern your access to and use of the website, classes, courses, coaching, doula support, postpartum support circles, lactation education, digital materials, community spaces, and related services offered by Chorion Birth / Intuitive Birth (“Chorion Birth,” “Intuitive Birth,” “we,” “us,” or “our”).

By purchasing, enrolling in, accessing, attending, participating in, or using any of our services, programs, materials, or website, you (“Client,” “Participant,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you may not purchase, enroll in, access, attend, participate in, or use our services, programs, materials, or website.

1. Services Covered by These Terms

These Terms apply to all Chorion Birth / Intuitive Birth offerings, including but not limited to:

  • Childbirth education classes and courses;

  • The Intuitive Birth program;

  • Private pregnancy coaching;

  • Doula support, birth support, postpartum doula support, and related non-medical support services;

  • Postpartum support circles, parent groups, and community gatherings;

  • Lactation education and feeding support;

  • Live virtual sessions, in-person sessions, recorded sessions, written materials, worksheets, downloads, emails, community discussions, and other educational resources;

  • Any other pregnancy, birth, postpartum, newborn, lactation, or parenting-related educational or support offerings provided by us.

The specific services included in your enrollment or purchase will depend on the program, package, tier, or offering you select at checkout or by written agreement.

2. Educational and Supportive Scope Only — No Medical Advice

You understand and agree that all services, programs, materials, classes, coaching, doula support, postpartum support, lactation education, and community discussions provided by Chorion Birth / Intuitive Birth are for educational, informational, emotional, practical, and non-medical support purposes only.

Chorion Birth / Intuitive Birth does not provide medical advice, diagnosis, treatment, clinical recommendations, prescriptions, medical decision-making, therapy, emergency care, or licensed healthcare services.

Unless expressly stated otherwise in writing, we are not acting as your physician, midwife, nurse, nurse practitioner, lactation consultant, therapist, mental health provider, dietitian, pediatrician, or other licensed healthcare provider.

Our services are not a substitute for care, advice, diagnosis, or treatment from your licensed medical provider, midwife, pediatrician, mental health provider, lactation consultant, or other qualified professional.

You agree that all medical questions, clinical decisions, health concerns, pregnancy complications, labor decisions, birth decisions, postpartum recovery concerns, mental health concerns, newborn care questions, feeding concerns, and lactation concerns must be directed to your licensed healthcare provider or other appropriate qualified professional.

3. No Provider–Patient Relationship

Participation in any Chorion Birth / Intuitive Birth service, program, class, coaching session, doula support, postpartum support circle, lactation education offering, or community space does not create a doctor–patient, midwife–client, nurse–patient, therapist–client, lactation consultant–client, or other licensed clinical provider relationship between you and Chorion Birth / Intuitive Birth.

4. Pregnancy, Birth, Postpartum, Lactation, and Newborn Risks

You understand that pregnancy, childbirth, postpartum recovery, lactation, infant feeding, and newborn care involve inherent risks and unpredictable outcomes.

You voluntarily assume full responsibility for your pregnancy, birth, postpartum, feeding, lactation, parenting, and newborn care decisions, including decisions made after receiving educational information, support, or resources from Chorion Birth / Intuitive Birth.

You agree that you are responsible for consulting with your licensed healthcare provider before making medical decisions or changing any care plan.

5. Emergency Disclaimer

Chorion Birth / Intuitive Birth does not provide emergency services.

In the event of a medical, mental health, pregnancy, birth, postpartum, lactation, feeding, newborn, or other emergency, call 911 or go to the nearest emergency room immediately.

You agree to contact 911, your licensed healthcare provider, your midwife, your pediatrician, or the appropriate emergency service immediately for urgent or emergency concerns, including but not limited to:

  • Vaginal bleeding;

  • Severe pain;

  • Decreased fetal movement;

  • Rupture of membranes or suspected rupture of membranes;

  • Signs of preeclampsia;

  • Fever or infection symptoms;

  • Chest pain, difficulty breathing, fainting, or severe dizziness;

  • Thoughts of harming yourself or others;

  • Newborn breathing concerns, dehydration concerns, fever, lethargy, or feeding emergencies;

  • Any concern that feels urgent, unsafe, or beyond educational support.

6. Lactation and Feeding Education

Any lactation, chestfeeding, breastfeeding, pumping, bottle-feeding, formula-feeding, milk supply, latch, newborn feeding, or infant care information provided by Chorion Birth / Intuitive Birth is educational and supportive only.

Unless expressly stated otherwise in writing, our lactation-related services do not replace individualized medical care from a pediatrician, IBCLC, licensed healthcare provider, or other qualified professional.

You agree to contact your baby’s pediatrician, your healthcare provider, an IBCLC, or another qualified professional for concerns including but not limited to poor weight gain, dehydration, jaundice, low diaper output, severe nipple or breast pain, mastitis symptoms, fever, suspected tongue tie, allergies, reflux, medication questions, supplementation decisions, or any urgent feeding issue.

7. Doula Support Scope

Doula support, if provided, is non-medical emotional, physical, informational, and practical support during pregnancy, labor, birth, postpartum, and/or early parenting.

Doulas do not perform clinical tasks, diagnose conditions, prescribe treatment, make medical decisions, speak on your behalf to medical providers, override medical advice, or guarantee birth outcomes.

You remain responsible for your own medical decisions and for communicating directly with your healthcare providers.

8. Client Responsibilities

You agree that you are responsible for:

  • Consulting your licensed healthcare provider about all medical questions and decisions;

  • Providing accurate and complete information when relevant to the support being requested;

  • Using your own judgment when applying educational information;

  • Seeking emergency care when needed;

  • Participating respectfully in classes, circles, and community spaces;

  • Maintaining the confidentiality and privacy of other participants;

  • Ensuring that any partner, spouse, co-parent, family member, birth partner, or support person who attends or accesses materials understands and follows these Terms.

9. Partner, Support Person, and Family Member Acknowledgment

If your partner, spouse, co-parent, family member, birth partner, or other support person attends a session, accesses materials, participates in a class, joins a community space, or relies on information provided by Chorion Birth / Intuitive Birth, you agree that they are also covered by these Terms.

You represent that you have authority to share these Terms with them and to ensure that they understand:

  • The information provided is educational and non-medical;

  • They must seek medical advice from licensed providers for clinical concerns;

  • They may not copy, distribute, or share Chorion Birth / Intuitive Birth materials;

  • They release Chorion Birth / Intuitive Birth from liability to the fullest extent permitted by law.

Chorion Birth / Intuitive Birth may require a support person to sign or acknowledge a separate release before attending live sessions, participating in services, or accessing materials.

10. No Guarantees

Chorion Birth / Intuitive Birth makes no guarantees regarding pregnancy, labor, birth, postpartum, lactation, feeding, newborn, relationship, emotional, or parenting outcomes.

Education and support may help you feel more informed and prepared, but they do not eliminate the inherent risks or unpredictability of pregnancy, childbirth, postpartum recovery, lactation, infant feeding, newborn care, or parenting.

We do not guarantee:

  • A specific birth experience;

  • A vaginal birth;

  • An unmedicated birth;

  • Avoidance of induction, cesarean birth, interventions, complications, pain, trauma, or medical procedures;

  • A specific postpartum experience;

  • Successful breastfeeding, chestfeeding, pumping, milk supply, or feeding outcome;

  • Any particular emotional, physical, medical, or family result.

11. Community Spaces, Group Sessions, and Confidentiality

Some services may include group classes, community discussions, postpartum support circles, online forums, messaging groups, or other spaces where participants may share personal information.

You agree to respect the privacy of other participants and not to record, screenshot, copy, share, identify, publish, or disclose another participant’s personal story, image, name, pregnancy details, birth details, postpartum details, feeding details, or other private information without their express consent.

Although Chorion Birth / Intuitive Birth asks participants to respect confidentiality, we cannot guarantee that other participants will keep information confidential.

Community spaces are not medical spaces and are not subject to HIPAA. Chorion Birth / Intuitive Birth is not a HIPAA-covered entity unless expressly stated otherwise in writing.

We will treat your communications with care and discretion, but you understand that group and community settings involve privacy limitations.

12. Recordings

Live virtual sessions, classes, workshops, or group calls may be recorded and made available to enrolled participants.

By attending a recorded session, you consent to being recorded, including your name, voice, image, chat comments, and participation, unless you choose to keep your camera off, change your display name, or refrain from speaking.

Recordings are provided for personal use by enrolled participants only. You may not copy, download, distribute, sell, publicly post, or share recordings without written permission.

13. Intellectual Property

All Chorion Birth / Intuitive Birth content, including but not limited to class materials, course materials, recordings, worksheets, guides, downloads, slides, videos, emails, frameworks, exercises, written content, logos, graphics, website content, and other resources, is owned by Chorion Birth / Intuitive Birth or licensed to us.

Your purchase or enrollment gives you a limited, personal, non-transferable, non-commercial license to access and use the materials for your own personal education and support only.

You may not copy, reproduce, distribute, resell, teach from, publish, upload, share, modify, or create derivative works from our materials without prior written consent.

14. Website Use

You agree to use our website and services only for lawful, personal, and non-commercial purposes.

You agree not to:

  • Interfere with the operation or security of the website;

  • Attempt to gain unauthorized access to our systems, accounts, data, or materials;

  • Copy, scrape, reproduce, or download website content for commercial use;

  • Submit false, misleading, defamatory, abusive, unlawful, or infringing content;

  • Upload viruses, malware, spam, or harmful code;

  • Use our website or services in a way that violates any applicable law or the rights of others.

We reserve the right to refuse service, cancel access, remove content, or terminate participation if we believe you have violated these Terms or acted in a way that is unsafe, unlawful, disruptive, or harmful to us or others.

15. Payments

You agree to pay the pricing, fees, deposits, payment plans, or other charges associated with the service, program, tier, package, or offering you select at checkout or by written agreement.

If you choose a payment plan, you authorize us or our payment processor to charge the payment method provided according to the payment schedule presented at checkout or agreed in writing.

Failure to complete payment may result in suspension or termination of access to services, classes, materials, recordings, community spaces, or support.

16. Refunds, Transfers, and Cancellations

Because our offerings may involve reserved capacity, limited enrollment, preparation time, live support, access to digital materials, and/or immediate access to educational content, all sales are final unless otherwise stated in writing or required by law.

Unless a different refund policy is clearly stated on the checkout page or in a written agreement:

  • No refunds are available once a live program, cohort, circle, class, or service has begun;

  • No refunds are available once digital materials, recordings, downloads, or course content have been accessed;

  • No refunds are available for missed classes, missed sessions, missed circles, unused support, or failure to participate;

  • Requests to transfer to a later cohort or class must be made before the start date and are subject to availability;

  • Private coaching, doula support, and postpartum support cancellation or rescheduling policies may be set forth in a separate written agreement.

Nothing in this section limits any rights you may have under applicable law.

17. Scheduling and Availability

For private coaching, doula support, postpartum support, lactation education, or other individualized services, scheduling is subject to availability.

We will make reasonable efforts to provide services as described, but availability may be affected by illness, emergencies, birth attendance, weather, technology issues, travel delays, family emergencies, or events outside our control.

If we need to reschedule a session or modify the format of a service, we will make reasonable efforts to provide an alternative time, substitute support, recorded material, credit, or other reasonable accommodation, depending on the nature of the service.

18. Testimonials, Feedback, and User Submissions

If you submit feedback, testimonials, reviews, comments, photos, messages, suggestions, or other content to Chorion Birth / Intuitive Birth, you represent that you have the right to share that content and that it does not violate the rights of any third party.

We will not publicly use your full name, image, birth story, testimonial, or identifying personal information for marketing without your consent.

General feedback, suggestions, or non-identifying comments may be used by us to improve our services.

19. Privacy

Your use of our website and services may involve the collection of personal information. Please review our Privacy Policy for information about how we collect, use, and protect personal information.

You understand that email, online forms, messaging apps, video platforms, checkout platforms, and community spaces may involve third-party services and may not be fully secure or confidential.

Please do not submit urgent medical information through email, forms, messaging platforms, or community spaces.

20. Disclaimer of Warranties

Our website, services, programs, materials, recordings, community spaces, and related offerings are provided “as is” and “as available.”

To the fullest extent permitted by law, Chorion Birth / Intuitive Birth disclaims all warranties, express or implied, including but not limited to warranties of accuracy, completeness, reliability, fitness for a particular purpose, uninterrupted access, availability, and non-infringement.

We do not warrant that the website, checkout system, recordings, digital materials, community spaces, or third-party platforms will be uninterrupted, timely, secure, error-free, or available at all times.

21. Release of Liability

To the fullest extent permitted by New York law, you release and hold harmless Chorion Birth / Intuitive Birth and its owners, officers, directors, employees, contractors, doulas, educators, facilitators, agents, representatives, affiliates, service providers, and licensors from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses arising out of or related to:

  • Your participation in any class, course, coaching session, doula support, postpartum support circle, lactation education, community space, or other service;

  • Your use of or reliance on any educational materials, information, recordings, discussions, suggestions, or resources;

  • Pregnancy, labor, birth, postpartum, lactation, feeding, newborn, parenting, medical, emotional, or family outcomes;

  • Decisions made by you, your partner, your support person, your family, or your healthcare providers;

  • Actions or omissions of healthcare providers, hospitals, birth centers, midwives, physicians, nurses, lactation professionals, therapists, pediatricians, or other third parties;

  • Technical issues, missed sessions, access interruptions, or third-party platform issues.

This release does not apply to liability that cannot be waived under applicable law.

22. Limitation of Liability

To the fullest extent permitted by law, Chorion Birth / Intuitive Birth shall not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or similar damages, including but not limited to emotional distress, lost income, lost profits, loss of data, replacement costs, or damages arising from pregnancy, birth, postpartum, lactation, feeding, newborn care, or parenting outcomes.

If, notwithstanding these Terms, Chorion Birth / Intuitive Birth is found liable for any claim, our total aggregate liability shall not exceed the amount you paid to Chorion Birth / Intuitive Birth for the specific service giving rise to the claim during the six months before the claim arose, to the fullest extent permitted by law.

23. Indemnification

You agree to indemnify, defend, and hold harmless Chorion Birth / Intuitive Birth and its owners, officers, directors, employees, contractors, doulas, educators, facilitators, agents, representatives, affiliates, service providers, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your breach of these Terms;

  • Your participation in or use of our services, materials, website, or community spaces;

  • Your violation of any law or the rights of another person;

  • Your actions, omissions, decisions, or representations;

  • Claims brought by your partner, spouse, co-parent, family member, support person, guest, or other third party who attends, accesses, receives, or relies on our services or materials through you.

24. Grievance Policy

We are committed to maintaining a respectful, professional, and supportive environment.

If you have a concern or complaint about a service, class, circle, doula support experience, coaching relationship, facilitator, or interaction with Chorion Birth / Intuitive Birth, you may submit a grievance by email to [insert email address].

A grievance should include:

  • Your name and contact information;

  • The date or approximate date of the issue;

  • A clear description of the concern;

  • Any relevant documentation or context;

  • The resolution you are seeking, if any.

We will review grievances in good faith and may, at our discretion, take steps such as requesting additional information, facilitating a conversation, offering a reasonable resolution, modifying future participation, or taking no action if we determine no further action is warranted.

Submitting a grievance does not guarantee a refund, specific outcome, disciplinary action, or continued participation.

25. Force Majeure

Chorion Birth / Intuitive Birth will not be responsible for delays, cancellations, interruptions, inability to provide services, website unavailability, or failure to perform due to events beyond our reasonable control, including but not limited to illness, emergencies, birth attendance, family emergencies, acts of God, natural disasters, severe weather, strikes, labor disruptions, internet failures, technology failures, power failures, platform outages, government actions, public health emergencies, or other circumstances beyond our control.

26. Termination

We may suspend or terminate your access to services, programs, materials, recordings, community spaces, or the website if we believe you have violated these Terms, failed to make required payments, infringed our intellectual property, disrupted a class or community space, violated another participant’s privacy, acted abusively or unlawfully, or created a safety concern.

The obligations and liabilities incurred before termination will survive termination.

27. Electronic Agreement

By checking the box at checkout, clicking “I agree,” submitting payment, enrolling, creating an account, accessing materials, attending a session, or otherwise participating in our services, you agree that your electronic acknowledgment has the same force and effect as a handwritten signature.

You agree that these Terms constitute a legally binding agreement between you and Chorion Birth / Intuitive Birth.

28. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Unless otherwise required by law, any legal action arising out of or relating to these Terms or your use of Chorion Birth / Intuitive Birth services shall be brought in the state or federal courts located in New York.

29. Dispute Resolution

In the event of a dispute, you agree to first contact Chorion Birth / Intuitive Birth in good faith so that we may attempt to resolve the issue informally.

If the dispute cannot be resolved informally, the parties agree to pursue resolution as required by applicable law and any dispute resolution provision included in a separate signed agreement between the parties.

30. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised “Last Updated” date.

Your continued use of the website, services, programs, materials, or community spaces after updated Terms are posted means you accept the updated Terms.

31. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law or severed from these Terms, and the remaining provisions shall remain in full force and effect.

32. Waiver

Our failure to enforce any provision of these Terms shall not be considered a waiver of our right to enforce that provision or any other provision in the future.

33. Entire Agreement

These Terms, together with any checkout terms, written service agreement, privacy policy, or program-specific policies provided to you, constitute the entire agreement between you and Chorion Birth / Intuitive Birth regarding your use of our website, services, programs, materials, and community spaces.

If there is a conflict between these Terms and a separate written agreement signed by both parties for private doula support, coaching, or other individualized services, the separate written agreement will control for that specific service.
